What is a notary public?

A Notary Public is a bonded public servant commissioned by the Wisconsin Secretary of State to facilitate signings and administer oaths.​ A Notary Public is an impartial witness, and deters fraud by identifying information or entering into an agreement knowingly and willingly. Affidavits, Deeds of Trust,  and Powers of Attorney are examples of documents which require notarization. It is important to note that a Notary Public is not authorized to give legal advice by law.

What is a loan signing agent?

A certified Loan Signing Agent is a specialized witness who visits the borrower's home or business to expedite loans or refinance signings. The Signing Agent meets the borrower with the loan documents and ensures that signatures, initials and dates are in all the appropriate places. The Signing Agent then notarizes the required signatures, and returns the documents to the lender pursuant to their instructions.​ A Loan Signing Agent adds convenience to the loan process, ensures that deadlines are met, and works with the highest level of diligence and integrity.

What does a notary public notarize?

A Notary Public notarizes any document in which the originator needs to ensure the integrity of the signer. A notary public verifies the identity of the signer, and that are signing knowingly and willingly. This process helps deter the fraudulent execution of documents.

What is Remote Online Notarization?

When conducting a remote notarization, a signer personally appears before the Notary at the scheduled time of notarization using audio-visual technology over the internet instead of being physically present in the same room. Remote online notarization is also called webcam notarization, online notarization or virtual notarization.

How does a notary verify the identity of a signer?

A Notary will ask the signer for an acceptable document that may serve as identification. Acceptable forms of identification may include:

Government issued driver's license

State issued I.D. card

United States Passport

A passport issued by a foreign government if stamped by the U.S. immigration and Naturalization service

Military I.D. card

Is a Notary Public allowed to prepare or assist in the preparation of any documents?

A Notary Public is not allowed to assist or prepare documents. A Notary Public can only witness the signing of documents. To assist or prepare documents would be an unlawful practice of law. This keeps the Notary's position as an impartial witness to the signing.

Can a Notary refuse a notarization?

A Notary Public may refuse to perform a notarization if he or she cannot be certain of a signer's identity, willingness, or understanding of what is happening at that moment. Furthermore, a Notary may not notarize a document in which he or she has a financial interest.

What do I need to get a document or form notarized?

To have a document notarized, a current and valid form of identification is required in addition to the document you plan to have notarized.
